地方《终身学习促进条例》的立法选择——基于教育法律体系的整体视野

         

摘要

In an overall framework of the legal system,guiding,assessing and guaranteeing the construction of lifelong education system and building a learning society with concrete legislation can not only be conducive to logic and coverage cycle between laws with-in the education legal system,but also to avoidance of the severe challenges a local government would face in interpretation of the con-cept of lifelong education when exploring the relevant legislation. Therefore,we should adjust our legislative thinking in the overall framework,base upon the access to universal learning and lifelong learning. With protecting citizens' rights and interests in learning and promoting the learning society as the goal,we should choose legislative practice of the local"Lifelong Learning Promotion Rules and Regulations".%在教育法律体系的整体架构下,通过具体立法来指引、评价和保障终身教育体系构建以及学习型社会建设,不仅有利于教育法律体系内部法律之间的逻辑严密、覆盖周延,也有利于避免地方在探索终身教育相关立法时,面临终身教育理念解读的严峻挑战.因此地方应当在教育法律体系的整体框架下,调整立法思路,立足全民学习和终身学习,以保障公民学习权益,促进学习型社会为目标,选择开展地方《终身学习促进条例》的立法实践.
