引入小说资料提升中国法制史教学效果

摘要

There are abundant legal materials in China ancient novels.They possess the characteristics of vividness, meticulosity, integrity and popularity.There are some significances bringing materials of novels in teaching history of China law or other legal subjects, such as turning abstract provisions into concrete examples; knowing the differences and contradictions between legislation and enforcement, feeling and law; thinking about nationality of law; improving the teaching interest.They also have many shortcomings, such as falsity, selectivity, fragment and repeatability.People should strengthen the identification and combine other legal materials when they use materials of novels in the teaching.%中国古代小说含有丰富的法律资料，相对于传统法律资料，具有生动性、细致性、完整性和民间性特点。中国法制史甚至其他法学课教学中应引入小说资料，其意义有：化抽象的法条为具体的事例；认识立法与执法、情与法的差距与矛盾；思考法律的民族性；增加教学的趣味性。小说法律资料亦有缺点，如虚假性、选择性、片段性和重复性，引入课程时需要加强甄别，并与其他法律资料结合使用。
