涉外刑事庭审语境与口译员角色困境

摘要

In the context of Chinese court proceedings,the presiding judge holds the biggest power,who can actually decide whether to continue or adjourn the proceedings and how to continue them.It is at his dis-cretion to interrupt the parties present at court or to demand them to repeat or to proceed on a certain topic. However,with a courtroom interpreter’s participation in a trial,this pattern of power structure has established a trend toward discretion sharing.This study observes the interpreter’s role in the discretion sharing structure in the courtroom setting and analyzes the significances and difficulties for an interpreter in that role.%在中国大陆刑事庭审的语境中，法官（尤其是审判长）是掌握最多话语权的人。在涉外刑事庭审语境下，口译员参与了法官对庭审的控制，话语权力分配结构发生了变化，客观上存在与法官分权的现象。文章通过对中国大陆涉外刑事庭审语境下口译员分权现象的观察和研究，分析其角色对庭审语境物理、社交和心理世界的影响，探讨其角色定位的历史和体制的樊篱，揭示法庭口译员所客观面临的语言、法律和道德困境。
