摘要

The Chinese laws in regard to curbing the extraction of confessions by torture have undergone a process of gradual improvement and perfection since 1979. Not only do relevant legal norms concerning extracting confessions by torture become increasingly normalized on a large-scale and systematic basis, but also the operability of these legal norms has been greatly enhanced. An overview of the Chinese legal picture of curbing the practice of extracting confessions by torture will conduce to the further improvement of Chinese legal mechanisms in respect of curbing the practices of extracting confessions by torture.%从1979年至今纵向地看,中国遏制刑讯逼供的法律呈现出一个由不完善到逐渐完善的不断健全和完备的图景。中国遏制刑讯逼供的法律规范不仅逐渐走向了规模化和体系化,而且也已初步实现了规范的精细化,其可操作性渐趋增强。纵览中国遏制刑讯逼供的法律图景,有利于对中国遏制刑讯逼供法律机制的进一步完善。
