网约车崛起背景下出租车规制制度改革探讨

网约车快速崛起,原因在于其技术、经济特征和经济模式适应城市出行需求,虽然引发管制争议,但经过立法博弈,赋予网约车的合法化地位的规制制度已经实施.网约车对出租车形成巨大的挑战,也预示着改革发展的契机.出租车本身具有比较竞争优势,但是落后出租车管制体制和以牌照租赁为核心的经营模式限制了其潜在的竞争优势发挥.出租车行业改革的方向是适应市场需求,发挥比较竞争优势.为此,出租车管制制度需要进行市场化变革,并引发出租车经营模式向市场化方向转型.出租车规制制度改革需要联动考虑网约车的管制制度.%The rise of the internet chauffeured car business has resulted from the technical and economic characteris-tics and the economic model that is very suitable for the needs of urban travel.Although a regulatory dispute was trig-gered off over it,the regulatory system was implemented and it was legalized.The internet chauffeured car business note only has brought great challenges to the ordinary taxi business,but also bred an opportunity for the reform and development of the taxi business.The backward regulatory system and the license-oriented model limited its poten-tial competitive advantages.The future of its reform should be market-oriented to meet demands.Therefore,the re-form of the taxi regulation system should be market-oriented and be coordinated with the regulation system of the in-ternet chauffeured cars.
