浅析中国BOLAR例外适用

摘要

BOLAR exception means that it shall not be an act of infringement to make, use, offer to sell, or sell or import a patented invention solely for uses reasonably related to the development and submission of information under the law which regulates the manufacture, use, or sale of drugs or veterinary biological products. Through the introduction and analysis of BOLAR exception systems, the writer wants to find the problems and solutions of BOLAR exception system in China.%BOLAR例外是指“制造、使用、许诺销售、销售或者进口被授予专利的发明的行为,如果单纯是为了依照有关法律的规定获得并提供为制造、使用或者销售药品或者兽医用生物产品所要求的有关信息,则不构成侵犯专利权的行为.”本文通过对我国BOLAR例外相关法律的介绍,针对我国目前的现状,提出我国BOLAR例外实施中需要关注的问题及其解决方法.
