目的论视角下的商务法律文献翻译研究——基于《中华人民共和国海商法》英译本

摘要

随着我国对外交往与合作的迅猛发展，商务法律文献翻译，尤其是汉英翻译的需求和作用日益凸显。但传统上，国内外译界对法律翻译的理论研究比较轻视，有关商务法律文献的科研还刚刚起步。因此，本文在前人研究的基础上，运用功能目的论，结合具体的实例，尝试归纳了一套系统、有效的翻译策略和翻译方法，希望能够有助于提高我国汉英商务法律翻译的质量。
　　 通过评析《中华人民共和国海商法》官方英译本，我们发现了商务法律文献有其特殊的特点和翻译难点，需要比普通翻译理论更有针对性的理论指导。本文认为，这类语篇往往术语繁多，很多措辞富有中国特色，但在法律英语中缺乏对应的表达法，给翻译带来了许多障碍；同时句式偏长、结构复杂、常用无主句、修饰成分层层叠叠、缺乏英语等形合语言中必须的标记语，大大增加了翻译的难度；在总体上，商务法律文献又以其正式书面、精深专业、一丝不苟而著称，也对其翻译提出了很高的要求。
　　 对此，本文提出，我们要以功能目的论为指导，遵循准确、地道、简明等原则，采取一系列翻译方法，克服上述障碍。只有这样，才能生产出优秀的商务法律文献的译本。
