讼卦之“讼”辩正

摘要

目前学术界普遍存有对《周易》讼卦之“讼”的误读，这种误读甚至影响到了司法实践。事实上以历史语境言，“讼”从来源看具有必然的天理，从含义看具有丰富的法蕴而非仅指“诉讼”，从属性看则具有吉性而非为“终凶”，从深度看也绝无“无讼”之义。虽然历史上学术受政治影响是个不争的事实，但在构建和谐社会的今天，对讼卦之“讼”进行学术辩正仍有必要。%The academics generally misread the word ＂Sung＂ of divinatory Sung in Yi at the moment, and such misreading even influences judicial practice. Actually, in the context of history, lawsuit has necessary justiee in the level of origin, abundant legal meanings （ not lawsuit alone） in the level of content, good luck （ not ＂final ill luck＂ ） in the level of attribute and not ＂no lawsuit＂ meaning in the level of profundity. Although it＇s a indisputable fact that academic has been historically influenced by politics, it＇ s necessary to proceed academic dialectic on ＂Sung＂ of indivinatory Sung nowadays when building harmonious society.
