摘要

Legal person system is a legal system of private law nature and human nature from the construction process of the le-gal person system and the foundation of the system of legal sense.For the legal person,improve the autonomy,establish the functional,improve the subjectivity such as the basic function.Therefore,by giving independent legal guarantee for higher uni-versity,the legal person system can teach professionals independently,academic discussions,to provide social need of talents in the new period,and finally realize the basic implementation of the public interest in the education function.This is the reali-zation of legal justice,independence,value,the basic embodiment,is to achieve the necessary guarantee of legal autonomy of universities,and is the main operating mechanism of effective governance for higher universities.%从高等学生法人制度的建设过程和法人制度的根本意义来看，法人制度是具备私法人性质和公法人性质的法律制度，对法人个人，具备提高自主性、确立功能性，完善主体性等基本功能和意义，因此，从本质上说，高等学校法人制度通过赋予高等学校独立的法律保障，使其能够独立自主的教导专业人才，展开学术讨论，为社会提供新时期需要的人才，并最终实现公众利益在教育作用中的基本实现，这是实现法律公正性、独立性、价值性的基本体现，是实现高等学校法律自治的必要保障，是有效治理高等学校的主要运转机制。
