从物权秩序视角审视善意取得制度

摘要

The theory of“appearance of rights”is the foundation and premise which the property order shaped from the bona fide acquisition system.Under the guidance of this theory,the security and efficiency of the transaction became value orientation of the bona fide faith acquisition system,but the static security is same important as that of transaction,the security protection of transactions is the outcome of the interest balance and the stability of the substance order is the goal that systems exist.The credibility of the public trust is inversely proportional to the level of the Bona fide identification standard.The standard would be improved if the credibility is weakened by “unusual transactions”,“special traders”and “objection registration”etc.Only comprehensive consideration taken into goodwill and elements of publicity can get the effect of stabilizing the property order and interest balancing.%权利外观理论是善意取得制度形成物权秩序的基础和前提，在此理论引导下，交易安全、效率成为善意取得制度的价值导向，但静态安全与交易安全同等重要，交易安全的保护实为利益平衡下的产物，而物质秩序的稳定亦为制度存在的目的。公信力强弱反比于善意认定标准的高低，若存在“非正常交易条件”、“特殊交易主体”及“异议登记”等弱化公信力的情形时，善意的认定标准将有所提升。唯有综合考量善意及公示要件，方得物权秩序稳定之效、利益平衡之果。
