英文原创合同与英译合同对比研究：对比语料库方法

摘要

This study compares English contract and English translated contract, aiming to find differences between them. Using corpus driven method, comparing word frequency and word keyness of the English contract corpus and English translat-ed contract corpus, and observing concordance lines of these words, the study analyses 15 words in translated contract corpus and 13 words in English contract corpus. The research findings show that translated contracts attempt to abide by target lan-guage norms in terms of legal language features, but is restrained by the source language in contract content, logic and culture.%对比英文原创合同与英译合同可以发现英译合同与英文原创合同的区别，为合同英译和英文合同起草提供语言帮助。运用语料库驱动方法，通过比较英文原创和英译合同两个语料库的词频和关键词，可以找出两个语料库区别于对方具有代表性词汇。在对英译合同中的15个词及英文合同中的13个词的用语索引观察的基础上，可以分析出这两种语言具有代表性的特征。本研究发现译文合同在法律语言形式上尽量靠近目标语，而在内容、逻辑及契约文化上仍受源语较多影响。
