防卫意识作为正当防卫构成要件的再认识

Justifiable defense is the legal regulation w hich confirms the legality of possible dangerous be‐haviors of the victims or the third parties in practicing justifiable defense against crimes ,so the victims or the third parties must have the defense consciousness .For the accidental defense ,however ,because there is no defense consciousness and the behavior itself has no legitimacy ,is not justifiable defense .%正当防卫是刑法对受害人或者第三人在实施正当防卫行为中的客观上的危害行为的性质予以确认合法的制度，因此正当防卫行为必须具有防卫意识。偶然防卫因为没有防卫意识且其行为本身没有防卫行为的正当性，因而不是正当防卫。
