FERC’s Office of Enforcement Issues 2018 Enforcement Report

OE staff told the commissioners at the November 15 meeting that market manipulations schemes have become more sophisticated, but the commission has access to market data and new analytics to analyze the data. Among the highlights of the report, in 2018 the investigations staff opened 24 new investigations and closed 23 pending investigations with no action, and staff negotiated six settlements that resulted in more than $83 million in civil penalties and disgorgement of more than $66 million in unjust profits. Enforcement staff has negotiated settlements that resulted in the recovery of approximately $776 million in civil penalties and $511 million in disgorgements, since 2007.
