A group of Florida property owners asked the U.S. Supreme Court during oral arguments Dec. 2 to reverse a state supreme court decision allowing government erosion-control efforts to restore a beach in Destin, Fla., with the new beach becoming the property of the state (Stop the Beach Renourishment Inc. v. Florida Department of Environmental Protection, U.S., No. 08-1151, oral argument 12/2/09).rnThe property owners are asking for a rule that would allow a court action to be deemed a "judicial taking" for the first time.rnThe case is about taking "oceanfront property" and turning it into "ocean view property" by separating the property owners from contact with the Gulf of Mexico, D. Kent Safriet, an attorney from Tallahassee, Fla., who represented the property owners, told the Supreme Court.
