未成年犯社区矫正中的检察研究——以《刑法修正案（八）》为视角

摘要

The relevant provisions of the community correction in the amendment of criminal law eight resolved the legal basis of community correction about juvenile offenders,which affirmed the successful experience of community correction from the legal sense.But,with the full implementation of community correction about juvenile offenders,some deep problems have been exposed.The legal supervision of procuratorial organ about community correction about juvenile offenders met issues which related with the above deep problems closely such as lacking legal basis,lacking intervention mechanisms,which seriously restricted the perfection of community correction about Juvenile Offenders.Through a series of measures to improve the legal supervision of procuratorial organ about community correction about juvenile offenders we will promote the development of community correction about juvenile offenders.That will also play an important role in perfecting the community correction legislation.%《刑法修正案（八）》中有关社区矫正的规定,从法律意义上肯定了社区矫正在我国试行的成功经验。但是,随着未成年犯社区矫正工作的全面推行,一些深层次问题也暴露出来。检察机关对未成年犯社区矫正的法律监督所遇到的法律依据欠缺、缺乏介入机制等问题与上述深层次问题紧密相联,严重制约了未成年犯社区矫正工作的完善。通过一系列措施完善检察机关对未成年犯社区矫正的法律监督对推动未成年犯社区矫正工作的有效开展和完善社区矫正立法具有重要作用。
