国家通过立法规定新农合参加者的资格、权利和义务，对于维护广大农村居民的利益、维护社会公平和推进法治中国建设具有重要的意义。确定新农合参加者的资格应遵循普遍性和排他性原则，具有农村户籍是新农合参加者的基本资格。新农合参加者还应享有费用补偿权，知情权，自由选择权，监督批评权，救济权等法律权利。新农合参加者也应承担按时足额缴纳个人费用，如实提供个人信息材料，遵守法律制度等法律义务。%It is vitally important for rural area and rural residents to regulate the qualifications, rights and duties of the participants of new rural cooperative medical system through law. To determine the qualification of participants in new rural cooperative medical system should follow the principles of universality and exclusiveness. Rural residence registration is a basic qualification for participants of new rural cooperative medical system. The main legal rights of participants in new rural cooperative medical system are the right of compensation,the right to know,the right to freedom of choice,the right of supervision and criticism,the right of remedy.
