试述新型农村合作医疗参加者的资格•权利•义务

The main participants in new rural cooperative medical system should be rural residents. Because of its broad coverage, relatively complex situation, the state should set up regulations to define the qualification, rights and obligations of the participants in new rural cooperative medical system to ensure its sustainable and healthy operation. We should follow the principles of universality and exclusiveness to identify the participants' qualification; and the participants shall enjoy the following main legal rights: the right to compensation, the right to be aware of the truth, the right of free choice, supervision and criticism, relief and prosecution, etc.; and the participants shall bear the following main legal obligations:timely and full pay of the personal cost, providing true personal information and materials, credit consumption, and abiding by the management systems, etc..%新型农村合作医疗的参与主体应为农村户籍居民。由于该项医保覆盖面极为广泛、情形较为复杂，为保障其能够持续、健康良性运行，国家需要立法规定“新农合”参加者的资格、权利和义务；确定“新农合”参加者的资格，应遵循普遍性原则和排他性原则。“新农合”参加者所应享有的法律权利，主要包括费用补偿权、知悉真情权、自由选择权、监督批评权、救济起诉权等；所应承担的法律义务，主要包括按时足额缴纳个人费用、如实提供个人信息材料、诚信消费、遵守管理制度等。
