中国集体协商制度的反思与重构

     

摘要

Collective consultation is the core of the labor relations system of the modern marketing economy and a major way to solve labor conflicts. Frequent labor disputes at present in China have made the implementation of the collective consultation system more important as the system plays significant role in coordinating the relations between capital and labor, protecting the rights and interests of laborers and improving the economic development and social stability. However, problems still exist in respects of legislation, status of the union, contract contents, consultative grade and governmental supervision. Thus, it is necessary to further perfect the system so as to make it more effective in solving labor conflicts and disputes.%集体协商是现代市场经济国家劳动关系制度的核心,是解决劳资冲突的一个重要途径。随着我国日益增多的劳资纠纷,集体协商制度的推行也变得尤为重要。集体协商制度对于协调劳资关系、维护劳动者的合法权益、促进经济发展与社会稳定具有极其重大的意义。我国现行的集体协商制度在立法层次、工会地位、合同内容、协商级别、政府监督等方面存在着一系列的问题,致使集体协商对劳资冲突的解决效果并不理想。因此,在当下的中国应进一步完善集体协商制度,使其在处理劳资关系中发挥应有的作用。
