论社会契约理论制约权力的内在逻辑

摘要

近代西方诞生的社会契约论是一份崭新的政治生活蓝图,它以强大的权力制约逻辑驯服了国家这个巨大的＂利维坦＂。如果说＂以权力制约权力＂是国家内部权力之间的一种制约形式,制约力量内在于国家权力自身,那么＂以社会制约权力＂强调社会力量对国家权力的制约,制约力量来自国家权力之外,是自下而上的制约。只有以社会制约权力为基础,两种制约力量互相促进,才能真正实现对国家权力的制衡。%The birth of theory of social contract has made a new blueprint for modern political life in the West.With its power restriction logic,theory of social contract tames State,the huge ＂Leviathan＂.If ＂power to power＂ is a form of restriction to state power from within and the strength of restriction originates from state power itself,＂society to power＂ is a reversed and bottom-up form from the outside,which emphasizes on the restrictions of social forces to state power.Therefore,a balanced restriction to state power would be realized on the basis of ＂society to power＂ through the mutual promotion of society and state power.
