检察机关指导性案例之拘束力研究——以基层检察机关为视角

摘要

In order to improve the work level of guiding cases as well as fully develop and play the roles of typical cases and make sure the unity of justice and judicial justice, the fortieth meeting of the eleventh session Committee of the Supreme People's Procuratorate considered and passed The Supreme People's Procuratorate Provisions on Case Instruction Work which aims to standardize case instruction work in the way of guiding case. As a member of grass-roots procuratorial organ, we think that although guiding case is applied to be used, it should have binding force for procuratorial organ of local every level. Moreover, the binding force of guiding cases can be guaranteed by choosing high quality case strictly, strengthening application effect through administrative means, and adopting external supervision and internal motivation on application.%为提升案例指导工作水平，充分挖掘和发挥典型案例的作用．确保司法统一与司法公正，最高人民检察院第十一届检察委员会第四十次会议审议通过了《最高人民检察院关于案例指导工作的规定》，以指手性案例的形式规范案例指导工作。作为基层检察机关工作人员，笔者认为指导性案例虽是参照适用．但对地方各级检察机关应当具有拘束力，并可以从严格遴选优质案例、通过行政手段强化适用效果、对适用情况进行外部监督和内部激励等方面保障指导性案例的拘束力。
