论上帝作为立法者的意义

在深受基督教影响的西方社会，世界秩序乃是由上帝所立之法安排这一理念被普遍接受。上帝是唯一的立法者，“人”不能为“人”立法。虽然人因此在上帝面前失去了自由，却在同类的他人面前获得了自由与平等，并从“上帝面前人人平等”合乎逻辑地导源出了“法律面前人人平等”。唯上帝为立法者的理念，对西方社会宪政观的形成与宪政实践以及西方法治社会的实现都有重要的意义和影响。%It is generally accepted that in Western society,which is deeply influenced by Christianity, the world order is established by the Law of God.Since God is the only legislator,man cannot make law for himself.Hence,man lost his freedom in front of God,which,however,ensured him to be free and equal in front of other human beings.Equality of all before God can logically deduce that everyone is equal under law.The theory that God is the only legislator has a significant meaning and influence in the formation and implementation of constitutionalism and realization of law-governed society.
