宪政视角下的中国传统政治文化

摘要

Although there is no written constitution documents in traditional China,many constitutionalism factors still can be found in China’s traditional political culture from the higher and broader view.These constitutionalism factors play an important role as the fundamental law in traditional Chinese political operation.According to the culture genetics,it is the bad ecological environment but not traditional culture that made the constitutionalism gene has not turned into constitutional system.%如果以广角远景镜头观察中国历史,尽管传统中国并没有出现成文的宪法文件,但是中国传统政治文化当中并不缺乏宪政的因素,这些因素在中国古代的政治运行当中发挥着根本法性质的作用。根据文化遗传学的观点,中国传统政治文化当中的宪政基因长期以潜在的形式传递而没能生长成宪政的制度,其根本症结在于恶劣的生态环境,而不是在于中国传统政治文化自身。
