基于分权制衡视角的大学内部治理研究

摘要

In the university’s internal governance, the confusion of headmaster or president, rule by man or by law, and autocracy or democracy, the mix and unbalance of academic power and administrative power, and a mere formality of democratic administration and supervision by faculty lead to the power disequilibrium of university’s governance. The modern university system must be set up to distribute the power of university’s internal governance, effectively balance the power by regulation and mechanism, and promote the efficient governance with the power-restrain-power.%大学内部治理面临“班长”与“校长”、“人治”与“法制”、“个治”与“共治”的困惑，学术权力与行政权力混淆失衡，教职工参与民主管理和监督流于形式，导致了大学治理权力失衡。建立现代大学制度，发挥“制度”、“机制”作用，对大学权力进行有效制衡，在权力约束权力中，促进大学内部权力的有效治理。
