网络中介服务提供者知识产权侵权责任的发展与革新

摘要

After the exploration and development of legislation and judicial practice for more than ten years, a similar tendency is found in the USA, EU and China on the issue of intellectual property rights infringement liability of internet intermediary. There are two trends, strict as well as lenient, seeming contradictory but in fact complementary and dependent on each other. The dynamic role of the judicial practice for legal development and the dynamic role of tort liability for social development have been revealed during this process. The liability innovation of internet intermediary is only one aspect of the response of legal system to the technology challenges, and the social progress is promoted by the interaction of technology and law.%历经十余年立法与司法实践对网络中介服务提供者知识产权侵权责任的探索与发展，欧美与中国对于网络中介服务提供者基本范畴及责任承担规则的认识，在较大程度上呈现出趋同趋势。在这一过程中可以看到一严一缓两种看似矛盾，实则互为依赖和补充的侵权责任发展方向，其间司法对于制度发展的能动作用以及侵权责任对于社会发展的能动作用显现出来。网络中介服务提供者侵权责任的革新，只是法律制度回应信息技术挑战的一隅，而社会也正是在科技与法律制度的双重推动下取得进步。
