侵权人不明建筑物坠物致人损害之受害人救济问题探析

摘要

There frequently occur cases of falling objects of unknown infringers from buildings that cause injuries to people.The 87 provision of Act of Liability for Tort of the People’s Republic of China stipulates the right of the victim to claim compensation on responsible building users.However,this rule is unfair for the probable innocent inflictors.While relieving the victims,it may cause certain burden on the innocent inflictors and often the relief may be inadequate.Based on the analysis of current deficient legislation and relevant views of the theoretic field, this article offered some personal viewpoints .%侵权人不明建筑物坠物致人损害的案件屡有发生，《中华人民共和国侵权责任法》第87条规定了受害人有向可能加害的建筑物使用人的补偿请求权，但该条规定对于无辜的可能加害人不公平。在对受害人救济的同时，也给其造成了一定的负担，并且往往救济力度不够。在分析现行立法的不足及理论界相关观点的同时，试图对此问题提出相应的解决办法。
