微博直播庭审的困境与规制

摘要

With the development of network technique ,the live broadcast of the court trial with mi‐croblog has become a new style of public judicature and has developed at a high rate of speed .The live broadcast of the court trial with microblog promoted the trial more open and strengthened the supervision to judicial authority .Meanwhile ,the institution or system of live broadcast of the court trial with microb‐log is not perfect .There are many conflicts between supervision and privacy .And the scope and category of case which is broadcast is not always clear and definite .So ,in order to make the live broadcast with mi‐croblog play an active role in promoting judicial openness ,justice and credibility ,we need to establish the legal mechanism of broadcast with microblog ,particularly in the matter of starting rule ,subject and the information release .%随着网络技术的发展，微博直播庭审成了我国当前司法公开的一种新方式，而且呈现出较快的发展趋势。微博直播庭审在促进审判公开、加强司法监督等方面发挥优势的同时，也存在微博直播庭审制度缺失、监督权与隐私权相冲突、直播案件范围不确定和信息发布边界不清晰等困境。因此，应对微博直播庭审进行规制：制定和完善微博直播庭审的法律法规，完善微博直播庭审的启动程序，确定微博直播庭审的主体，限定微博直播庭审的案件及内容，明确庭审信息的发布规则。从而使微博直播庭审在促进司法公开、司法公正和提升司法公信力等方面发挥积极作用。
