论顶岗实习学生人身伤害法律救济的路径选择

顶岗实习学生遭受人身伤害后可以寻求劳动法、侵权法和保险法等进行法律救济，但每种法律救济路径均有其局限性。为充分保障顶岗实习学生的权益，切实推进顶岗实习作为教学环节的顺利实施，必须完善相关法律制度，构建多元化的法律救济路径。%When suffered personal injury,the students in post practice can seek legal relief from the Labor Law, Tort Law and Insurance Law,etc.but each way has its limits.In order to protect the students'rights and safe-guard the implementation of post practice,it is necessary to complete the relevant legal institutions and structure diversified legal relief methods.
