Autopilot system is one of the core areas of artificial intelligence,and poses a challenge to the exist-ing traffic order.In terms of the important components of traffic accident,autopilot system is an eligible candi-date for traffic accident,as in accidents related to autopilot system,there is a link between the damage and the system,and there is subjective negligence.But these accidents should be analyzed according to different situa-tions.In order to regulate the development of autopilot system,it is necessary to formulate relevant regulations and standards in advance and together with corresponding traffic laws and regulations,in order to quickly incor-porate the autopilot system into the traffic order.%自动驾驶系统是现阶段人工智能的核心发展领域之一,对现有的交通秩序构成了挑战.在交通肇事罪的重要构成要件上,自动驾驶系统符合交通肇事的主体要件,损害结果和自动驾驶系统之间有因果关系,并且主观上具有过失,从而分析出自动驾驶系统构成交通肇事罪,但应该根据不同的情况具体分析.为了规范自动驾驶系统的发展,需要提前制定相关法规和标准,并配套相应的交通法规,促使自动驾驶系统早日融入交通秩序中.
