人大常委会制度实践面向的法理基础

摘要

Appropriate handling of the legal basis helps the functioning of the Standing Committee of People’s Congress system.The Standing Committee of People’s Congress system contains three aspects of legal basis:the nature,status and conference.Due to the lack of abidance of relevant legal basis,the Standing Committee of People’s Congress system cannot realize many functions.In fact,the situation can be improved from two phases:fact and norms.%把握法理基础有助于人大常委会制度功能的实现。人大常委会制度蕴含着性质、地位、会议三个方面的法理。由于没有充分遵循其相关法理基础，人大常委会制度运行无法实现其更多功能。而促进人大常委会运行遵循法理基础可以从事实、规范两个层面来进行。
