我国金融消费者权益受损:特征分析与政策建议

     

摘要

由于我国金融体系法律依据不足,金融监管不完善,信息不对称严重,金融消费者素养较低以及纠纷解决不畅等,导致侵害金融消费者合法权益事件频发,金融投诉数量总体先升后降,侵害金融消费者权益涉及多方面,金融消费者维权比例较低。金融消费者的监管保护、自律保护、自我保护、市场保护、法律保护等方面均有不足。为提升我国金融消费者保护水平,应该健全金融消费者机构监管制度,强化金融消费者市场保护力度,弥补金融消费者司法保护缺陷,提高自律组织保护水平,金融消费者自身也应不断提高自我保护能力。%Violations of financial consumers'legal rights and damage of their interests occur frequently in China due to a number of institutional defects,such as the lack of legal basis,imperfect financial supervision,serious asymmetric information,low financial literacy,and inefficient dispute settlement. The number of financial complaints has been rising first and falling then.The violation of financial consumers'rights involves many different aspects,but the proportion of consumers'appealing to law is relatively low due to the institutional shortcomings in consumers'financial supervision,the law protec-tion,self-protection,the market protection,and the legal protection.To improve Chinese financial consumer protection mechanism,this paper contends that we should enhance the financial consumer agency supervision system,strengthen financial consumer protection and remedy j udicial defects of fi-nancial consumer protection,raise the protection ability of self-discipline organizations,and improve the consumers'self-protection ability.
