视听作品作者署名权新论——兼评《著作权法修改草案》'作者精神权利'的修改

摘要

The Berne Convention provides the moral right for authors. Films and works expressed in the way similar to films are an important type of work under the protection of the Berne Convention.Films and television works fall in the category of this kind of work, while audiovisual works as a new concept, cover this kind of work. The moral right is the characteristics of the Copyright Law under the civil law system. The right of authorship is an important moral right to show the relationship between the author and the works. Although the Copyright Law under the common law system does not provide a right of authorship for audiovisual works, the signatory of authors and co-authors is very normative. While Chinese Copyright Law provides the right of authorship for audiovisual works , the actual practices witness a very chaotic situation and frequently confuse the signature of audiovisual works with the right of authorship for audiovisual works. The draft revised Copyright Law adds a new concept of audiovisual works to cover new types of works, such as network videos and network live broadcasts, in addition to films and television works. The right of authorship for audiovisual works needs to be further improved.%《保护文学和艺术作品伯尔尼公约》有"作者精神权利"的规定,"电影作品和以类似摄制电影的方法表现的作品"是《伯尔尼公约》保护的重要作品类型,电影和电视属于该类作品的代表,视听作品成为可以涵盖该类作品的新概念."作者精神权利"是作者权体系的特色制度,署名权是表明作者与作品之间关系的作者的重要精神权利.版权体系虽没有视听作品署名权的专门规定,但参与方的署名非常规范.我国著作权法虽有视听作品署名权的规定,但是实践中非常混乱,普遍将视听作品上的"署名"与视听作品的"署名权"混同.《著作权法修改草案》新增"视听作品"概念,以涵盖电影、电视、网络视频、网络直播等新型作品,"视听作品"署名权的规定有待完善.
