上海市2009～2013年医疗执业行政处罚案件分析

摘要

目的：了解上海市2009～2013年医疗执业行政处罚案件的特点，为改善医疗执业行政处罚工作提供参考。方法收集和整理上海市卫生监督综合应用平台中的医疗执业卫生行政处罚案件数据，运用Excel 2007进行分析。结果5年案件总数为9799件，来源于监督检查和投诉举报分别占78.70%、18.71%，投诉举报案件从2009年的195件增加至2013年的444件；单案由案件和多案由案件分别占99.27%、0.73%；一般程序和简易程序案件分别占96.25%、3.75%；给予警告、罚款和警告+罚款的案件分别为占25.45%、63.15%和3.17%；平均罚款额为5110元，最高罚款额和最低罚款额分别为376134元和50元。结论监督检查是医疗执业行政处罚案件的主要来源，来源于社会举报的案件数有逐年上升趋势；案件主要以单案由和一般程序案件为主；处罚种类以罚款和警告为主。%Objective To know the features of medical practice administrative penalty cases in Shanghai from 2009 to 2013 and provide suggestions. Method Our data were collected from health supervision integrative application platform of Shanghai and analyzed by Microsoft Excel 2007 Software. Results During the 5 years, the number of medical practicing ad⁃ministrative punishment cases is 9799, cases from the supervision and inspection and complaint or reporting accounted for 78.70%and 18.71%respectively, complaints cases increased from 195 to 444 from 2009 to 2013;Brief of a case and brief cases accounted for 99.27% and 0.73% respectively; General procedure and summary procedure cases accounted for 96.25% and 3.75% respectively; Cases given warnings, fines and warnings + fines accounted for 25.45%, 63.15% and 3.17%;Medical practicing fine cases averaged 5110 yuan, maximum fines and minimum fines are 376134 yuan and 50 yu⁃an respectively. Conclusions Supervision and inspection is the main source of medical practice administrative penalty cases, the number of cases reported from the community has increased year by year;Cases are mainly composed of Brief of a case and general procedures;Penalty types are given priority to with fines and warning.
