《农村土地承包法修正案(草案)》要义评析

摘要

研究目的:明晰中国土地改革背景下科学与民主立法(修法)的价值方向.研究方法:以法规范分析为主,从法解释学与立法论的结合维度进行探求.研究结果:《农村土地承包法》修法正当其时,但修法与民法典分则修订起草的关系应加以研究,修法的科学性不容忽视,立法技术亟待提升.研究结论:该立法修正案(草案)极有必要重新整合,尤其需要深刻理解"三权分置"政策意蕴,进而将其转换为符合法逻辑体系的立法制度设计.%The purpose of this paper is to clarify the value orientation of the scientific and democratic legislation (law amendment) in the context of China land reform. The methods used are mainly based on normative analysis of law together with legal hermeneutics and legislative doctrine. The result indicates that it's the appropriate time to amend the Rural Land Contract Law and more studies should be made on the relationship between the revision of the Rural Land Contract Law and the Specific Provisions of the Civil Code. In order to improve our legislative technology, more attentions should be paid to the scientificity of law revision. In conclusion, it's essential to reintegrate the Amendment (draft) especially in comprehensively understanding the tripartite rural land entitlement system and hereafter convert it into our legislative construction.
