论教育机构的侵权责任——以《侵权责任法》为视角

Educational institutions on the tort liability of the minor students,there is an urgent need of legal attention.＂Tort Liability Act,＂according to the minor age of the students area of responsibility of the kindergarten,school or other educational institutions are divided into three conditions on the composition and distribution of responsibility tends to be more refined,emphasis on the protection responsibilities of the school the minor students is the kind of educational and management responsibilities.Accurate positioning of the legal relationship of minor students and educational institutions,analysis and appraisal of the fault of the tort liability of underage students and educational institutions identified standard,list the scope of duty of care of a good administrator,to better protect the rights of minor students.%教育机构对未成年学生的侵权责任,迫切需要法律予以规范。《侵权责任法》依据未成年学生的年龄把幼儿园、学校或者其他教育机构的责任区分为三种情况,在责任的构成和分配上更趋于精细化,强调学校对未成年学生的保护职责是一种教育、管理职责。本文对未成年学生与教育机构的法律关系进行了分析,论证了未成年学生与教育机构侵权责任的过错认定标准,列举出善良管理人注意义务的范围,以期更好地保护未成年学生的各项权利。
