On March 1, 1994, complainant Zenith Electronics Corporation filed a motion towithdraw the complaint and terminate the investigation without prejudice (Motion 363-2). The Commission investigative staff supports the motion. Termination of this investigation is necessary because a federal district court in parallel litigation (the U.S. District Court for the Northern District of Illinois) granted a motion for partial summary judgment of non-infringement in favor of respondents. The same combination patent, the '647 patent, that is in issue here was in issue in the district court declaratory judgment case.
