CONGRESSIONAL RESEARCH SERVICE EXAMINES LEGAL ISSUES SURROUNDING PIPELINE SITING DECISIONS BY THE STATES AND THE FEDERAL GOVERNMENT

Just days before the Administration's decision to reject the Keystone XL Pipeline application, the Congressional Research Service released publicly a report completed in December -- Legal Issues Associated with the Proposed Keystone XL Pipeline -- that found generally that state oversight of pipeline siting decisions does not appear to violate federal law or the Constitution. The report also found that the State Department's implementation of its authority to issue Presidential Permits appears to allow for judicial review of its National Environmental Policy Act (NEPA) determinations.
