Raw milk supporters survive first round in FDA challenge

A federal judge has rejected FDA's motion to dismiss a lawsuit challenging the agency's restrictions against selling raw milk across state lines.Since 1987, federal regulations have prohibited unpasteurized milk from being sold in interstate commerce in final package form (21 CFR 1240.61). But the Farm-to-Consumer Legal Defense Fund (FTCLDF), a non-profit organization, and eight individuals, argue that those rules are unconstitutional in a lawsuit filed Feb. 20 in the U.S. District Court for the Northern District of Iowa. They want the freedom to purchase raw milk in one state and transport it to states where raw milk sales are not allowed.
