The US Supreme Court announced 15 October that it will hear six cases concerning whether EPA has overextended authority under the Clean Air Act (CAA) by attempting to regulate greenhouse gas (GHG) emissions from stationary sources. The rules in question stem from the Supreme Court's 2007 decision in Massachusetts v. EPA, in which justices uphold EPA's authority under CAA to regulate any automotive emissions, including GHGs, that the agency judges to be harmful to public health. The agency's subsequent efforts to extend this authority to stationary sources, like power plants, have been among the Obama Administration's most aggressive and sweeping climate change initiatives.
