Cargill Inc. alleged Monday that it is being charged twice for diesel fuel costs by BNSF Railway in common carrier contracts covering a wide variety of commodities, according to an unreasonable practice complaint filed with regulators at the Surface Transportation Board. The case brought by the agricultural giant will be watched closely by bulk shippers with common carrier contracts, including electric utilities, which more typically operate under private contracts not subject to federal regulation. At the same time, an ongoing federal lawsuit that could have massive implications for freight haulers alleges that railroads colluded in development and implementation of fuel surcharges dating back to 2003.
