It has been the view of many commentators that the U.S. Supreme Court and the Circuit Courts of Appeals have confused the concept of disability as noted in the ADA with a benefits and social program definition. This can be seen in the Supreme Court's comments within the Toyota v. Williams decision of 2002, in which they said the ADA "should be interpreted strictly to create a demanding standard for qualifying as disabled." This approach has created some additional barriers for people with disabilities who turn to litigation as a remedy for discrimination.
