Rechtliche Rahmenbedingungen für den Einsatz des Nudging als staatliches Steuerungsinstrument

Nudging is a term that includes different types and degrees of influencing the decision process of consumers. If nudging is used by state institutions basic rights may be affected depending on the degree of interference. Not only if third parties are forced to do something in order to „nudge" consumers any interference with basic rights has to be justified taking into account the same standards as classical mandatory measures of state authorities.%Das Konzept des Nudging als alternativer Lenkungsform wird seit einiger Zeit vermehrt diskutiert, gerade auch im Bereich der Ernährungserziehung. Dabei stellen sich nicht nur verhaltensökonomische, sondern auch juristische, vor allem verfassungsrechtliche Fragen. Der nachfolgende Beitrag befasst sich vertieft mit der verfassungsrechtlichen Problematik des Nudging.
