摘要

One of the most mysterious aspects in the present international law of the sea is the regime of historic waters. Art. 10, para. 6, of the 1982 United Nations Convention on the Law of the Sea (LOSC), following Art. 7, para. 6, of the 1958 Geneva Convention on the Territorial Sea and the Contiguous Zone, provides that the conditions to be met for the closing of bays "do not apply to so-called 'historic' bays". This opens a legal vacuum and a theoretical conundrum, as nowhere in the LOSC is it specified what historic bays are and what other rules should apply to them.
