PacifiCorp will take FERC to court if fined for alleged violations said to spark deadly fire

PacifiCorp plans to take the Federal Energy Regulatory Commission to court to challenge a proposed $42 million fine for allegedly violating federal reliability standards that led to a major fire in Utah, if the commission proceeds with the enforcement case against the company. The electric power company and largest grid owner and operator in the West, serving 2 million customers across six states, has until July 16 to answer FERC’s April 15 show-cause order (IN21-6) in which FERC staff found PacifiCorp failed to comply with a mandatory reliability standard pertaining to a transmission line facility rating methodology. PacifiCorp said in a May 7 filing to FERC that its answer “will demonstrate … that the commission should close this matter without further action because PacifiCorp did not violate reliability standard FAC-009-1 R1, or its successor, FAC-008-3 R6, as alleged by the commission’s Office of Enforcement.”
