Judge Denies Motion to Bring Claims Against EPA in Fuel Credit Fraud Lawsuit

A federal district court has denied an energy broker's motion to refile its claim that mismanagement by the Environmental Protection Agency allowed fraudulent renewable fuel credits to enter the marketplace (Vinmar Overseas Ltd. v. OceanConnect LLC, S.D. Tex., No. 11-cv-4311, 11/29/12). In a Nov. 29 order, Judge Lee H. Rosenthal of the U.S. District Court for the Southern District of Texas said it would be "futile" to allow OceanConnect LLC to bring a claim against EPA under Texas law and the Federal Tort Claims Act after the court previously struck down a similar request.
