The Hong Kong Monetary Authority (HKMA) issued a circular on the transfer of customer data for use in marketing in August 2010. The circular is consistent with the opinion of the Administrative Appeal Board in the above case, for example it mentions that express consent from customers should be sought before the transfer or sale of personal data, and that the relevant contractual provisions should be in a reasonably readable size.
