“种房子”：拆迁中吊诡行为分析--以河塘村为个案

摘要

通过对河塘村拆迁过程中表现出来的吊诡行为的调查可以发现，村民种房子行为虽与其逐利动机相关，但其背后却潜藏着农民的生存伦理与地方性的社会文化逻辑。农民并不排斥法律，但认为法不责众，情大于法，体现了农民生活世界中的情、理、法之间的冲突。农民“种房子”行为从形式法角度而言是违法的，但在农民眼中却是合情合理的。“种房子”从另一个侧面反映了农民无声、隐忍的抗争。因此，拆迁的顺利进行不能忽略农民这种“合情合理”式的抗争。%Through the investigation on the paradox of acts conducted in Hetang village in the demolition process,we can find that the behavior of villagers is related to their pursuit for interests, but it involves the underlying social and cultural logic of the survival of farmers and local ethics.The farmers do not exclude the law, but they think that the law fails where vi-olators are legion and love is greater than the method, which reflects the conflict of emotions, reason and law in the farmers′living world.From the perspective of formal law, their behavior is illegal, but in the eyes of the farmers it is perfectly logical and reasonable.From another side, the behavior reflects the farmers voicelessness and tolerable struggle; therefore, the smooth progress of demolition cannot ignore the resistance of the farmers in"perfectly logical and reasonable"way.
