住宅用地“自动续期”：无实质意义的命题

鉴于现行国家标准所规定的住宅设计使用年限远远短于法律规定的居住用地使用权最长年限，《物权法》第149条所规定的“自动续期”在理论上不具有实质意义。在特定地区如青岛、温州等地，无偿续期有现实经济利益，但可能存在社会不公问题。国土资源管理部门似倾向于自动有偿续期。%The duration of residence regulated by national standard is shorter than that of the right to land. So, the au-to-continuation of the right to residence land has no substantial interest in theory. In Qingdao and Wenzhou, free auto-continu-ation has some economical interest. To do like that would cause social unfairness. The department of land management prefers the paid auto-continuation.
