Liu Zongyuan considered that the Shi Bing Chapter of Ho-Kuan-Tzu was plagiarized from Jia Yi's Fu-niao Fu because there were some same sentences between these two essays. However, this article would reveal that these two essays have used the same quotations from some classics in pre-Qin and Han dynasty, regarding three aspects: writing skills, literature style, authors' and works' thoughts and their historical settings. Therefore, the conclusion should be that they have the same theoretical resources, and were created in a close period. Moreover, Jia Yi wrote the Fu-niao Fu after reading the Shi Bing Chapter. The Shi Bing chapter was probably finished during early Han dynasty according to the study of Cao Mo's tale.%<鹖冠子·世兵>篇有些句子和贾谊<服鸟鸟赋>相同,柳宗元就认为是抄袭<服鸟鸟赋>,并而断定<鹖冠子>是伪书.本文从文体研究、编纂者的思想背景、撰写手法三方面来论证<世兵>篇与<服鸟鸟赋>都引用先秦秦汉的典籍,不能证明<世兵>篇抄袭<服鸟鸟赋>.相反,两者所反映的思想却有共同的时代背景,且思想重点不同.另外,<世兵>篇前部分记载曹沫一事,与后部分内容无涉.本文考证曹沫一事,推论本篇写成于战国末期与汉初之间.
