我国图书馆法立法道路检讨

摘要

我国图书馆法立法道路的特征是理性建构与政府主导,道路的选择有其历史与现实必然性,便于借助和利用政府所掌握的政治与立法资源,与我国政治经济文化环境是相适应的. 理性建构与政府主导的图书馆法立法道路的弊端之一是容易使法律与社会脱节,之二是容易导致法律的失效. 要提高图书馆法立法的质量,必须坚持科学立法和民主立法.%Government leading library legislation can provide convenience that lets library make use of politic and legislative resources being in the possess of government, which is reasonable and necessary based on historical and realistic views. However, government leading library legislation has two disadvantages, that is disconnecting library laws and society and leading to failure of library laws. In order to improve library legislation, scientific and democratic legislation can make an important contribution.
