浅谈我国食用农产品质量安全追溯法律制度建设

         

摘要

"Food Safety Law of the People's Republic of China" which was regarded as the strictest version in the history was implemented in October 2015, and establishing the food safety full traceability institution in our nation was put forward for the first time.This measure showed that our country had paid high attention to food safety work.According to putting a traceability system in legislation, the safety duty chain in which sources could be traced, fate could be verified and responsibility could be investigated was expected to be established in food full industry.Generally, food safety situation was turning good in our country.But because of weak foundation, food safety (including edible agricultural products) events frequently occurred and it threatened physical health and life safety of civilians.Establishing perfect food traceability system and implementation of the main body responsibility of managers could effectively improve food safety guarantee level and decrease the hazard of food safety events.According to the agricultural products quality safety traceability system legal institution of our country food, the problems existed in institution were analyzed.At the same time the successful experiences of edible agricultural products quality safety traceability system legal institution of EU were referenced and the feasible suggestions for completing the relevant legal institution in our country were put forward.%2015年10月,历史上堪称最严的《中华人民共和国食品安全法》正式实施,第一次明确提出国家要建立食品安全全程追溯制度.这一举措说明了国家对食品安全工作的高度重视,通过将追溯制度写进立法以期建设形成食品全产业"来源可追溯、去向可查证、责任可追究的安全责任链"[1].总体来看,全国食品安全情况逐步向好,但由于基础薄弱,食品安全(包括食用农产品)事件仍时有发生,威胁着老百姓的身体健康和生命安全.建立完善食品追溯体系、落实经营者的主体责任,可以有效地提高食品安全保障水平,降低食品安全事件的危害.
